(“SoundSafe,” “we,” “us”), and the following Privacy Policy (or “Policy”) explains how we may use and share Confidential Personal Information (“CPI,” including Visitors or Registered User’s full name, e-mail address, mailing address, telephone number, or credit card number, and or other information that may identify you) that you are required to provide to SoundSafe upon registration (also known as “Registration CPI”) to the website. This Privacy Policy applies to any and all features and services offered SoundSafe on our Website, any third-party application developer service and any other features (including audio or video embedded players), and any other Website features, content, or applications offered either now, or in the future by SoundSafe related to the Website. The Website is operated and hosted in the United States of America, and only those laws in that territory shall apply, regardless of Visitor’s location.
GENERAL USE
SoundSafe is the sole owner of the non-CPI information we collect on the Website unless specifically stated otherwise. However, we will not sell, share, or rent this information to any third party other than as disclosed in our Privacy Policy. We collect CPI and non-CPI from Visitors at several different on the Website, depending on the service or feature you access. Registered Users’ must provide names, email addresses, mailing addresses, phone numbers, fax numbers and other CPI and non-CPI. Registered Users’ of the Site must create a user name and password, and are responsible for the protection of such information. You must contact us immediately should any unauthorized person gain access to any CPI or other information, including user name and password.
SoundSafe may amend or change the terms of this Privacy Policy in adherence to changes in any laws, regulations or internal policy and practices established by SoundSafe. Any and all such modifications shall be immediately effective upon posting on the Website. Any continued use and access to the Website, and or our services after SoundSafe posts a revised Privacy Policy will act as your acceptance of the revised Privacy Policy. You are therefore responsible to read and understand the Privacy Policy, and any changes or modifications. If we materially change any practice related to the collection or use of your CPI, the Privacy Policy that governs your CPI will be the Policy under which any information was collected. You must provide SoundSafe any objection to any change in the Policy.
CHILDREN’S ONLINE PRIVACY PROTECTION ACT (“COPPA”)
Our Website has been developed for use of a general audience. SoundSafe recognizes the privacy interests of children, and therefore encourages parents and guardians, and or other adults, to take an active role in children’s Internet activities and interests. SoundSafe does not intentionally or knowingly collect information from any Visitor under the age of thirteen (13). For avoidance of doubt, SoundSafe is in full compliance with the Children’s Online Privacy Protection Act (“COPPA”). By accessing and using the Website, you hereby agree that you understand and agree to the provisions of COPPA, and any participation of the Website has been authorized by you and/or your parent or guardian.
CPI AND NON-CPI ON THE WEBSITE
Introduction
SoundSafe collects CPI from any Visitor as part of the registration process to become a Registered User of SoundSafe. SoundSafe may also collect CPI from you if you choose to participate in other features or Website services, including blogging, receiving or sending e-cards or e-mails outside or within the Website, newsletters, content submissions (“Visitor Submissions”) or any other information, or in connection with content or suggestions you submit to SoundSafe for review.
In addition, SoundSafe may other non-CPI including an IP address, user data, and browser type. This data is used to manage and improve our Website, maintain an interesting and compelling experience, track Visitor usage and interest, and for security purposes.
Registered Users’ may also choose to provide or store non-CPI information in their profiles, including but not limited to your age, general interests, hobbies, groups, affiliations, videos and/or pictures, internal e-mails. Any Registered User Profile is created at your discretion, provided, however, that SoundSafe retains the right and authorization in its sole discretion to terminate your Profile.
Registered Users’ may change any Registration CPI and identifying information at any time and may control how Visitors, other Registered Users’ and SoundSafe communicate with any one by maintaining control over account settings, which is accessible within the “Edit Profile” frame of the Registered User Profile.
Use of Cookies
“Cookies” are known as small pieces of information that SoundSafe sends to your computer. We uses cookies to identify your Internet browsing capabilities, store certain preferences, determine whether Visitors have installed software needed to access certain content on the Website and participate in the services. Information Disclosure
We reserve the right to disclose CPI or non-CPI submitted by or related to any Visitor as required by any law, rules, regulations, or in SoundSafe’s absolute discretion. Additionally, and without limitation, we reserve the right to disclose CPI or non-CPI when any Visitor or Registered User violates the Terms of Service or any other agreement with us, or engages (or is suspected of engaging) in any harmful, infringing or illegal activity; any threatening or abusive behavior or in any unauthorized access or infiltration, or any attempted access or infiltration of the Website, including but not limited to, to any and all law enforcement agencies for investigative or prosecutorial purposes. Visitors hereby agree that SoundSafe may disclose any CPI, with or without a subpoena, warrant, or other court order. Furthermore, you agree that SoundSafe we may be required to disclose any CPI in response to court, regulatory or administrative proceedings, orders, civil subpoenas, discovery requests, litigation or as otherwise required by law,. SoundSafe may also provide CPI or non-CPI in response to allegations of intellectual property infringement of any other person, entity, or SoundSafe, or in our absolute discretion. We also reserve the right, and in our absolute discretion, to suspend and/or terminate your Registration in the event of any suspected or alleged, illegal, infringing, or inappropriate activity, or in violation of our Terms of Service.
Visitors and Registered Users agree to allow SoundSafe to use CPI or non-CPI: (1) to alter or modify services and feature of the Website; (2) to determine which advertisements or sponsor messages, if any will be served to your browser; (3) to send you announcements, updates, and if applicable, other third party materials that we feel may be of interest to you; and (4) in our absolute discretion to uphold the integrity and vision of SoundSafe. Provided, however, Visitors may “opt out” of receiving these materials, as set forth below.
Disclosure of Registered Users’ non-CPI
Registered Users’ election of a user name or which may be provided to them upon registration to the Website is considered non-CPI. You agree that user names will be published on the Website and may be disclosed to others, including, but not limited to, to the public, other Visitors and/or Registered Users’ and to any third parties with whom we may provide such information. Additionally, you agree, acknowledge and understand that any or all CPI or non-CPI (including, but not limited to, your name) you may publish, provide, or submit in any public area of the Website, or in any content or material submitted, transmitted or posted by Visitors (including, but not limited to blogs, Registered User Profiles, reviews, content, submissions, or message boards), such information will become public information and will be published on the Website. Such CPI or non-CPI will be disclosed to other Visitors to the Website and to other third parties who may have authorized or unauthorized access to or otherwise see a display of such information. You hereby release, waive any claims against, and hold harmless SoundSafe, its related or affiliated entities, partners, parent, Registered Users’ subsidiaries, affiliates, sponsors, officers, directors, shareholders, representatives, agents, contractors, consultants, employees, from and against any and all claims and allegations whatsoever relating to any and all disclosure, sharing, or publication.
SOUNDSAFE’S PROTECTION OF CPI
SoundSafe maintains all reasonable, standard and commercially available technical and measures to safeguard against loss, theft, unauthorized use, disclosure or modification of any CPI and financial information provided to us. Visitors and Registered Users’ agree, however, to regularly check CPI and non-CPI to protect against any unauthorized use of such CPI and financial information. SoundSafe agrees to periodically amend and review our security policies and procedures to protect such CPI. Any Visitor or Registered User is ultimately responsible for the security of CPI, including any user name and password. ASSENT, COMPLIANCE AND CORRECTION OF CPI
SoundSafe Registered Users’ should regularly and periodically review any CPI you provide us, so that we accurately maintain and update all records. We will take reasonable steps to correct any CPI provided we receive adequate notice. Any Registered User can view and change registration information, CPI, or other preferences, and Profile Information by logging into your account and accessing features such as “Edit Profile” and “Account Settings.”
SoundSafe will honors all requests to discontinue use of any CPI or non-CPI, provided, however, Visitors agree that SoundSafe may retain any record of your CPI that is necessary to comply with applicable federal, state or local law, rules or regulations.
